Welcome to Cycleworld! These Terms of Service (“Terms”) govern your access to and use of the services, products, and website provided by Cycleworld Australia Pty Ltd (ABN: 79 115 810 216), trading as Cycleworld (“Cycleworld”, “we”, “us”, or “our”).

Our registered office and physical retail store are located at 317 Concord Rd, Concord West, NSW, Australia.

By accessing or using any part of our services, including browsing our website, making a purchase in-store or online, or utilising our workshop services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1. General Terms

1.1 Acceptance of Terms

These Terms constitute a legally binding agreement between you and Cycleworld. You represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

1.2 Amendments to Terms

We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website or services following the posting of any changes constitutes acceptance of those changes.

1.3 Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New South Wales, Australia, and the Commonwealth of Australia.

1.4 Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

1.5 Entire Agreement

These Terms and any policies or operating rules posted by us on this site or in respect to the service constitute the entire agreement and understanding between you and us and govern your use of the service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

2. Product Sales (Retail & E-commerce)

Cycleworld sells bicycles, accessories, and parts both through our physical retail store and our e-commerce website.

2.1 Product Descriptions and Availability

We strive to ensure that all product descriptions, images, and prices displayed on our website and in-store are accurate. However, errors may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
All products are subject to availability. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

2.2 Pricing

All prices displayed are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Prices are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed and will be set out in your order confirmation email, quote or tax invoice.

2.3 Order Acceptance and Confirmation

Your placement of an order, whether online or in-store, does not necessarily assure our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, errors in pricing or product information, or issues with payment verification.
For online orders, you will receive an order confirmation email once your order has been successfully placed. This email confirms that we have received your order, but it does not constitute acceptance of your order. Acceptance of your order and the formation of the contract of sale will occur when the products are dispatched from our store or are ready for collection (for Click & Collect orders).

2.4 Payment Methods

We accept various payment methods, including major credit/debit cards, bank transfers (for certain transactions), and third-party payment providers as indicated at the point of sale (e.g., Zip). By providing payment information, you represent and warrant that you are authorised to use the designated payment method and authorise us to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).

2.5 Shipping & Delivery (E-commerce)

Shipping costs and estimated delivery times will be calculated and displayed at the time of checkout for online orders. We use third-party couriers for delivery. While we endeavour to meet estimated delivery times, these are estimates only and we are not liable for any delays caused by the courier or unforeseen circumstances. Risk of loss and title for items purchased from Cycleworld pass to you upon our delivery to the carrier. Should the courier be found to be in breach of their terms of service we will assist with any suitable recovery options.

2.6 Click & Collect

If you choose our Click & Collect service, you will be notified when your order is ready for collection at our physical store located at 317 Concord Road, Concord West, NSW. You must present valid photo identification and your order confirmation when collecting your order. Orders not collected within a reasonable timeframe (e.g., 14 days) may be cancelled and refunded, subject to a restocking fee.

2.7 Returns, Refunds, and Exchanges (Australian Consumer Law)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

3. Workshop Services

Cycleworld operates a full-service workshop providing repair and maintenance services for bicycles.

3.1 Service Descriptions and Quotes

We offer a range of workshop services. Details of services and estimated pricing are available on our website, upon request or in-store. We will provide you with a quote for the work required before commencing any significant repairs. The final cost may vary if additional issues are discovered during the service, but we will endeavour to contact you for approval before proceeding with additional work that significantly exceeds the initial quote.

3.2 Booking and Drop-off

Workshop services may require a booking. You are responsible for dropping off and picking up your bicycle at our workshop during our operating hours.

3.3 30-Day Warranty on Conducted Work

We provide a 30-day warranty on all labour and parts installed by our workshop from the date of completion of the service. This warranty covers defects in workmanship and materials used in the repair.

This 30-day warranty is in addition to, and does not limit or exclude, any rights or remedies you may have under the Australian Consumer Law.

3.4 Uncollected Items

Bicycles or items left at our workshop for service must be collected within 30 days of notification that the work is complete. If items are not collected within this period, we reserve the right to charge a storage fee. After 90 days, and following reasonable attempts to contact you, uncollected items may be sold to recover costs or disposed of, in accordance with applicable NSW laws.

4. Layby Purchases

Cycleworld offers layby terms for purchases.

4.1 Layby Period

Our standard layby period is 3 months from the date the layby agreement is initiated.

4.2 Deposit and Payments

A minimum deposit (as specified at the time of agreement) is required to secure a layby purchase. Regular payments must be made throughout the 3-month period. The product will remain in our possession until the full purchase price has been paid.

4.3 Cancellation of Layby

You may cancel a layby agreement at any time before the final payment.
All layby agreements are subject to the specific terms outlined in the individual layby contract provided at the time of purchase, which will be consistent with the Australian Consumer Law.

5. Financed Purchases via Zip

Cycleworld facilitates financed purchases through Zip (zip.co/au).

5.1 Third-Party Financier

Zip is a third-party credit provider. When you choose to finance your purchase through Zip, you enter into a separate agreement directly with Zip.

5.2 Zip's Terms and Conditions

Your use of Zip for payment is subject to Zip’s own terms and conditions, privacy policy, and eligibility criteria. We strongly advise you to review these documents on Zip’s website (zip.co/au) before proceeding with a Zip payment.

5.3 Cycleworld's Role

Cycleworld’s role in financed purchases via Zip is limited to facilitating the payment transaction. We are not a credit provider, and we do not make decisions regarding credit approval or the terms of your finance agreement with Zip. Any queries or disputes regarding your finance agreement, payments to Zip, or your credit account should be directed to Zip directly.

6. Website Usage

6.1 User Accounts

If you create an account on our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

6.2 Intellectual Property

All content on this website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Cycleworld Australia Pty Ltd or its content suppliers and protected by Australian and international copyright laws.

6.3 Prohibited Conduct

You agree not to use our website or services for any unlawful purpose or to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances. You also agree not to:

We do not guarantee, represent or warrant that your use of our website will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the website will be accurate or reliable.

6.5 Limitation of Liability (Website)

To the maximum extent permitted by law, Cycleworld shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the website services or any products procured using the website, or for any other claim related in any way to your use of the website or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the website or any content (or product) posted, transmitted, or otherwise made available via the website, even if advised of their possibility.
